Service Terms & Conditions
Thank you for visiting the websites and associated domains of www.propreel.com (collectively, the “Sites”). These Terms of Use (“Terms”) settle the terms and conditions under which you may use video services offered by Company (“Site”), which is provided and made available to you by Propreel LLC (“Company”, “Propreel”, “we”, “our”, “us”).
Kindly note that by accessing and/or using the Site, you, your authorized representative and/or any entity you hereby represent (“you”, “your”) accept these Terms and the Privacy Policy and agree to be bound by them. Therefore, it is your obligation to read these Terms and the Privacy Policy carefully and make sure you agree with them before any access or use of the site.
You hereby represent and warrant that: (1) you have read the Agreement, understood the stated therein and you hereby agree to engage with the Company under its terms; (2) your age does not limit you from lawfully engaging in the Agreement and that you are not legally prohibited from entering into the Agreement; (3) you are authorized to enter into and perform the Agreement for yourself or for the entity the details of which were specified upon booking our services.
1) Services & Costs
The pricing for our online video packages applies exclusively to the services detailed within the package description for the specified property. Additional locations such as amenities, parks, or public areas are not included. Any supplementary services or special editing requests will incur additional charges, which will be invoiced separately.
2) Invoices & Payments
A scheduling fee of 25% of the total is required at the time of booking your video shoot. The remaining 75% of the balance for the video services will be automatically charged on the day of filming. Payments can be securely processed online via credit card.
3) Special Requests
Clients must communicate any special requests, such as specific shots or angles, at least 48 hours before the film date. The videographer will apply their professional expertise, considering factors such as the property’s condition and lighting, to capture the best possible footage. If a desired shot is missed due to a lack of prior instruction, a re-shoot fee of $50 will be incurred to capture the specific shot.
4) Video-Ready Condition
It is the sole responsibility of the client and/or homeowner to ensure the property is fully prepared for filming prior to the videographer’s arrival. While the videographer may make minor adjustments to optimize the shot, they are not authorized to move furniture, make significant alterations, or clean the property.
5) Turnaround Time
The standard delivery time for completed videos is 24-48 hours. If expedited service is required, please inquire about express options, which are available for an additional fee.
6) Cancellation & Postponement
If you need to cancel or reschedule your appointment, please provide a minimum of 12 hours’ notice. Cancellations made with less than 12 hours’ notice will result in the forfeiture of the scheduling fee, necessitating a new booking and associated fee.
7) Weather Conditions
In the event of unfavorable weather, we request that you reschedule your shoot at least 12 hours in advance. If you choose to proceed with the shoot under such conditions, please understand that the resulting video will reflect the weather at the time of filming, and no digital processing will be included to correct for these conditions. In cases of severe weather, where safety or equipment may be at risk, Propreel reserves the right to reschedule the shoot.
8) Client Presentation
The client is responsible for ensuring they are presentable for the video shoot. Propreel does not provide makeup, wardrobe, or hair services. It is the client’s responsibility to be prepared and appropriately dressed for the video shoot.
9) Inaccessible Property
Should the videographer be unable to film the property due to circumstances beyond their control—such as inability to access the property, excessive clutter, or unrestrained animals—the client will be charged the full scheduling fee.
10) Limitation of Liability for On-Site Injuries
1. Assumption of Risk
By engaging with Propreel's services, you acknowledge and agree that any on-site activities, including but not limited to filming, property walkthroughs, or other related services, carry inherent risks. You assume full responsibility for any risks, hazards, or injuries that may arise during the course of these activities.
2. Limitation of Liability
To the fullest extent permitted by law, Propreel, its affiliates, employees, agents, contractors, and representatives (collectively, "Propreel Parties") shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with any injury, loss, or damage incurred by you or any third party while on-site. This includes, but is not limited to, personal injury, property damage, or any other claims related to or arising from the on-site activities conducted by Propreel.
3. Indemnification
You agree to indemnify, defend, and hold harmless Propreel Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to any injury, damage, or loss incurred by you or any third party on-site, including any claims brought by third parties for injuries or damages sustained as a result of Propreel's services.
4. Insurance
Propreel maintains insurance coverage appropriate to its business operations, but this insurance is not intended to cover or extend to any claims related to on-site injuries. You are advised to maintain your own insurance coverage for any potential injuries or damages that may occur on-site.
5. Safety and Compliance
Propreel is committed to conducting its services in a safe and professional manner. However, it is your responsibility to adhere to any safety instructions or guidelines provided by Propreel. You agree to comply with all applicable laws, regulations, and safety standards while on-site.
6. Acknowledgment
By participating in or engaging with Propreel's services, you acknowledge that you have read, understood, and agree to the terms set forth in this Limitation of Liability for On-Site Injuries section.
11) Liability for Digital Files
In the unlikely event that digital files are lost, stolen, or destroyed due to circumstances beyond Propreel’s control—including, but not limited to, equipment malfunction—Propreel’s liability is limited to the return of all payments received or providing the client with a reasonable opportunity to reshoot the property.
12) Rights and Usage
All Propreel Real Estate Film Packages include a full-use license, granting the client the right to use the final video products in perpetuity.
13) Use of Client's Image and Likeness
1. Consent to Use
By engaging with Propreel's services, you consent to the use of your image, likeness, and any other visual or audio representation of you ("Client Content") in videos, photographs, and other media produced by Propreel. This consent includes the right to use, reproduce, distribute, and publicly display Client Content on our website and social media pages.
2. Scope of Use
Propreel may use Client Content for promotional purposes, including but not limited to:
Website: Displaying Client Content on our official website to showcase our services.
Social Media: Sharing Client Content on our social media platforms, including but not limited to Facebook, Instagram, TikTok, X, and LinkedIn.
3. No Compensation
You agree that Propreel shall not be obligated to provide any compensation or royalties for the use of Client Content. Your consent to use Client Content is given without any financial consideration.
4. Right to Withdraw Consent
You have the right to withdraw your consent to use Client Content at any time by providing written notice to Propreel. Please note that while we will cease further use of Client Content upon receipt of your withdrawal notice, any use of Client Content that has already occurred prior to the withdrawal will not be affected.
5. No Endorsement
Your consent does not imply any endorsement or association with Propreel beyond the scope of the agreed services. Propreel does not claim any ownership of your image or likeness and will use Client Content in accordance with the terms outlined in this section.
6. Displaying of Client Social Media Handles
Propreel will add the client’s social media handles in any social media posts to enhance your visibility.
